Understanding the Follow-Up Table

Our follow-up table serves as a comprehensive tool to keep you updated on the developments in your judicial review application. To ensure clarity, each row in the table represents a unique case and is identified by an internal file number. This file number is provided to you at the time of initiating the application or when you retain Pax Law for our services.

Privacy and Security

We understand the sensitivity of legal matters and the need to maintain confidentiality. Therefore, the follow-up table is encrypted with a password, ensuring that only authorized individuals can access the information. Rest assured, the password will be securely shared with you to along with your internal file number.

Moving from left to right, the subsequent columns contain important dates related to your application:

1. Application Initiation Date: The first column in front of your file number displays the date when your application was initially initiated in the court. This marks the starting point of your case.
2. GCMS Notes Date: The “GCMS Notes” column indicates the date when the officer’s notes related to your case were received. These notes are crucial as they offer insights into the decision-making process.
3. Memorandum of Facts and Arguments (Applicant’s Position): Column D shows the date on which the “Memorandum of Facts and Arguments” in support of your position was submitted to the Court. This document outlines the legal basis and supporting evidence for your application.
4. Memorandum of Argument (IRCC’s Lawyer): Column E represents the date when the lawyer representing the Immigration, Refugees, and Citizenship Canada (IRCC) submitted their own “Memorandum of Argument.” This document presents the government’s position regarding your application.
5. Memorandum in Reply (Exchange of Memorandums): Column F displays the date when we concluded the exchange of memorandums before the Leave stage by submitting a “Memorandum in Reply.” This document addresses any points raised by the IRCC’s lawyer in their memorandum.
6. Application Record Deadline (Column G): Column G shows the date that indicates the deadline for submitting the “Application Record” to the Court, which is 30 days after receiving the GCMS notes (as mentioned in column B). The Application Record is a compilation of all relevant documents and evidence supporting your case. Please note that if the deadline falls on a weekend, the parties are allowed to submit their memorandum on the following business day.
7. Days to Receive GCMS Notes (Column H): Column H represents the number of days it took to receive the GCMS notes from the date of initiating the application in the Court (as indicated in column A). These notes are essential for understanding the basis of the decision made by the IRCC and formulating a robust legal strategy for your application.
8. Average Days to Receive GCMS Notes (Black Ribbon – Cell H3): Located in the black ribbon at cell H3, you will find the average number of days it takes to receive the GCMS notes across all cases. This average provides an indication of the typical timeframe for obtaining this critical information.
9. Days to File Application Record (Column I): Column I displays the number of days it took for our team at Pax Law to file the “Application Record” with the Court. Efficiently filing the Application Record is crucial to meet the deadline and advance your case.
10. Average Days to File Application Record (Black Ribbon – Cell I3): Located in the black ribbon at cell I3, you will find the average number of days it took us to file the Application Record across all cases. This average provides insights into our team’s efficiency in handling the filing process.

Note: You may notice that the average number of days to file the Application Record might be higher than the allowed deadline of 30 days. This variation is a result of changes in the Court’s directions over the past two years. During this time, the court may have altered the timeline for filing the Application Record, affecting the overall average.

Yellow Box – Overall Success Rate

The yellow box within the table represents our law firm’s overall success rate over the years. This rate is calculated by comparing the number of cases we have won, both through settlements and Court orders, to the number of cases we lost or that the applicant chose to withdraw. This success rate provides insight into our track record in achieving favorable outcomes for our clients.

Searching Your Case

To search for your case in the follow-up table, we suggest using the following method:

• If you are using a Windows system, press Ctrl+F.
• If you are using a Mac system, press Command+F.

These commands will activate the search function, allowing you to enter your internal file number or any other relevant keyword to quickly find your case in the table.

Please note that if you are viewing the table on your phone, you may not be able to use these commands for searching. In such cases, you can scroll through the cases to find yours.
